VII. Governing Law and Dispute Resolution

7.1 Governing Law

  • Users within China: These Terms shall be governed by the laws of the People's Republic of China (excluding conflict of laws rules).
  • EU users: These Terms shall also be governed by relevant EU laws and regulations (including but not limited to the EU Consumer Rights Directive 2011/83/EU).
  • U.S. users: These Terms comply with the Uniform Computer Information Transactions Act (UCITA) and relevant state laws.

7.2 Dispute Resolution

Any dispute arising from or in connection with these Terms shall first be resolved through friendly negotiation. If negotiation fails:

  • Users within China: The dispute shall be submitted to the Ningbo Arbitration Commission for arbitration in accordance with its effective arbitration rules at that time.
  • EU users: You may file a lawsuit with the court having jurisdiction in your place of residence, or choose to submit the dispute to the International Chamber of Commerce (ICC) International Court of Arbitration for arbitration.
  • U.S. users: You agree to submit to the exclusive jurisdiction of the Federal District Court for the Central District of California, Los Angeles County.
